As it is BYOND has it's fair share of music or file sharing types of games/programs.

The question I have is if a company/DMCA (I think its called) was to go after one of these games/programs who would be liable?

Since BYOND doesn't have any sort of direct connection all files must go through the server where they are saved and then pushed to the client.

So is it BYOND's fault?
The programmers? even though BYOND doesn't have the correct tools.
or the Host as the files are being stored on that pc/server.

It's a touchy subject and I don't think file sharing games/programs that hold copyrighted material should be on BYOND in the first place.
Whoever the company decides to make liable is liable, essentially.

It's not nearly as touchy as you might think. People make it touchy by going crazy about it.
Does BYOND's software get used to support content that breaches copyright? Sure. All the time.
What's the best thing to do? Basically just to accept it and not make a big deal out of it.

It's only a big deal if someone makes it one, and making a fuss is basically just melodrama that nobody benefits from.
In basic terms, the only appropriate response to "X User is hosting files he shouldn't!!!!" is "Yeah, yeah. Great. Let me know when someone important, like a copyright holder, is knocking on the door."
Fair enough do file sharing games get submitted often?

It's not a big issue for me, I was just asking the question to be honest I don't care at all just thought it would be good to know..

Not really, no. The two most active I can think of are IconShare and Icon Ultima.
The host would be liable. BYOND is not the host.
