Unless you have a professional production with hundreds of thousands of dollars, I doubt it.

That depends entirely on the agreement you would have with the license holder, but it's a moot point because for an IP as popular as Naruto you would have to pay an enormous amount of money. This is ignoring the fact that unless you're already a known entity, you wouldn't even be able to get your foot in the door.

Just the act of a fangame existing is in violation of the law, and the copyright holder doesn't need any reason beyond that to make a claim.
