Summary:
Sen. Lindsey Graham (R-S.C.) vowed Thursday to do everything in his power to overturn the Supreme Court’s decision on Guantanamo Bay detainees, saying that "if necessary," he would push for a constitutional amendment to modify the decision.

Graham blasted the decision as "irresponsible and outrageous," echoing the sentiments of many congressional Republicans and President Bush.

For those who do not know, the writ of habeas corpus is a constitutional right that give prisoners detained wrongfully a means for pleading their case, to much dismay to the republicans and Bush administration holding "terrorists" in Guantanamo Bay.

To be fair, the Bush Administration argues that we have been invaded by those who are being detained at Guantanamo. In times of invasion, the Constitution allows for the suspension of the writ.

Of course, this has little relevance since those people are associated to no country or country's war declaration. And given that some of the detainees are American citizens, it does make sense that they would have the same rights as any other accused citizen.

We haven't been invaded though. You can only suspend it in the literal sense, and TBA is trying to argue that our invasion of the middle east somehow twists into them invading us, and then detains a lot of innocent people because they have a problem with the current administration or speak against it..
