For those who do not know, the writ of habeas corpus is a constitutional right that give prisoners detained wrongfully a means for pleading their case, to much dismay to the republicans and Bush administration holding "terrorists" in Guantanamo Bay.

We haven't been invaded though. You can only suspend it in the literal sense, and TBA is trying to argue that our invasion of the middle east somehow twists into them invading us, and then detains a lot of innocent people because they have a problem with the current administration or speak against it.. | |

Of course, this has little relevance since those people are associated to no country or country's war declaration. And given that some of the detainees are American citizens, it does make sense that they would have the same rights as any other accused citizen.
