I don't think so, they sell electronic goods, where this BYOND doesn't both companies are doing totally different things and aren't clashing with each other.

But I am unsure of the laws in America ..
I'm pretty sure this would be. It wouldn't be worth doing anything about though, especially in the state BYOND's in right now.

Although perhaps there is a difference between B.Y.O.N.D. and Byond.

I only found this why looking at BYOND's SEO situation on google which I must say is in pretty good darn shape!

I noticed this while searching for BYOND sucks, don't worry I was just looking at how BYOND stands when used with bad words (I used others many others), this website was on a forum apparently the customer service they offer is poor.

My goal was to offer Tom some tips on where he could improve SEO to get BYOND's name out in the world wide web a bit more, but it seems it's under control, so whomever set all that up kudos to them, so my efforts were pointless.
